Notice of Ordinance Proposed for Enactment
Notice is hereby given that the Borough of Sewickley Heights intends to enact the following Ordinance at its regular meeting to be held at 4:30 P.M. in the Borough Hall, 238 Country Club Road, on February 20, 2017.
Ordinance No. 315
An Ordinance of the Borough of Sewickley Heights, Allegheny County, Pennsylvania, dedicating land for use as a public park.
Whereas, the Little Sewickley Creek Watershed Association, Inc., a Pennsylvania nonprofit corporation, by a Special Warranty Deed dated December 21, 2016 and of record in the Department of Real Estate of Allegheny County in Deed Book 16658, Page 65 (the "Deed") conveyed to the Borough of Sewickley Heights (the "Borough") certain real property located in the Borough of Bell Acres with an address of Beech Ridge Drive, Sewickley, Pennsylvania 15143 and identified in the real property records of Allegheny County, Pennsylvania as Block and Lot No. 937-P-200 (the "Property"); and
WHEREAS, the Council of the Borough is committed to the preservation and protection of the Borough’s natural, scenic, historical, and cultural resources and has taken note that the Property is located adjacent to the Sewickley Heights Borough Park.
Whereas, it is the opinion of the Council of the Borough of Sewickley Heights that the topography, geographic location, and aesthetic qualities of the Property clearly demonstrate that it is so situated as to be eminently suitable for the use and enjoyment of the general public as a park.
Now, therefore, the Council of the Borough of Sewickley Heights hereby ordains and enacts as follows, incorporating the above recitals by reference:
Section 1. The Borough of Sewickley Heights hereby dedicates, in perpetuity, for use as a public park, that certain tract of land situate in the Borough of Bell Acres, County of Allegheny, and Commonwealth of Pennsylvania, more particularly described as follows:
ALL that certain tract known as Wagner Hollow (and also known as Wagner’s Hollow, Waggoner Hollow, and Waggoner’s Hollow), situate in Bell Acres Borough, Allegheny County, Pennsylvania, being more particularly described as follows:
Parcel H on a plan of lots known as "The Sewickley Heights Golf Estates Plan of Lots" which is of record in the Allegheny County Department of Real Estate in Plan Book Volume 161, pages 38-45.
CONTAINING 92.644 acres. BEING designated as Block and Lot 937-P-200.
UNDER AND SUBJECT nevertheless to the express conditions and restrictions that the premises conveyed hereby remain forever wild, with no structures whatsoever to be constructed thereon, for use only as a nature reserve and for nature study: simple dirt hiking and equestrian trails may be cleared and used for hiking and riding, but not for motorized vehicles. Should the premises cease to be used solely as provided herein, then the estate hereby granted to the Borough of Sewickley Heights, its successors and assigns, shall cease and determine and shall revert to and vest in the Western Pennsylvania Conservancy, its successors and assigns, the said reversion and vesting to be automatic and not requiring any re-entry or other act or deed.
And Grantee, for itself, its successors and assigns, by acceptance of this Deed, agrees with Grantor, its successors and assigns, that said restrictions and conditions shall be covenants running with the land, and that in any deed of conveyance of said premises or any part thereof to any person or persons, said restrictions and conditions shall be incorporated by reference to that certain deed from the Western Pennsylvania Conservancy to Grantor recorded in the Allegheny County Department of Real Estate at Deed Book Volume 8410, page 515, and the record thereof or as fully as the same are contained therein.
SUBJECT to an easement for the riding of horses and bridle trails as set forth in that certain Easement granted by the Western Pennsylvania Conservancy to The Sewickley Hunt Club recorded in the Allegheny County Department of Real Estate at Deed Book Volume 8360, page 341.
SUBJECT to a restriction that the property herein conveyed remain forever open and accessible to the community at all times of the year.
BEING the same property which the Western Pennsylvania Conservancy by its corrective deed dated October 22, 1990 and recorded in the Allegheny County Department of Real Estate at Deed Book Volume 8410, page 515, granted and conveyed to Grantor.
GRANTOR, for Grantor and Grantor’s successors and assigns, reserves and retains unto itself, to the extent not previously conveyed, all rights, title, and interests in and to the subsurface estate(s) underlying the land herein conveyed including, without limitation, all of Grantor’s right, title, and interests in and to any coal, oil, and gas, and minerals underlying the land including, without limitation, coal bed methane, oil, and gas, provided that access to and use of the surface of the property for the exploration, production, transportation, treating, compressing, storage, or processing of any coal, oil, gas or minerals, and the construction, development, infrastructure, staging or other practices appurtenant thereto or associated therewith shall be expressly prohibited.
Section 2. The Property is contiguous to, and is hereby incorporated into the Borough of Sewickley Heights Park (the "Park"), as established by Ordinance No. 100 of the Borough of Sewickley Heights, as the same may be amended from time to time, and shall hereafter be deemed to be a part thereof.
Section 3. The dedication of the Property is subject to the reservations, exceptions, covenants, conditions, and restrictions contained in the Deed.
Section 4. The dedication of the Property is subject to, and the Borough of Sewickley Heights specifically reserves, the right to operate, manage, maintain, improve, equip, regulate (by ordinance or resolution), and generally administer the Property and the uses or activities permitted therein, all with a view towards promoting the health, safety, and general welfare of the residents of the Borough of Sewickley Heights and the users of the Property as part of the Park. It is anticipated that the Borough of Sewickley Heights in the exercise of such right may permit the continuance of the Property for uses and activities permitted therein prior to the acceptance of the aforesaid Deed, may permit new uses and activities on the Property consistent with and not inimical to its primary purpose as a public park, and may provide that different portions or sections of the Property may have different permitted uses and activities or a variety of permitted uses or activities.
Section 5. The provisions of this Ordinance are declared to be severable, and if any sections, paragraphs, sentences, clauses, or phrases of the Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, paragraphs, sentences, clauses, or phrases of this Ordinance, but shall remain in effect, it being the legislative intent of the Council of the Borough of Sewickley Heights that this Ordinance shall stand notwithstanding the invalidity of any part thereof.
Section 6. All ordinances or parts of ordinances inconsistent with or conflicting with the provisions of this Ordinance are hereby repealed.
